Information Request (Freedom of Information Act and Solomon Amendment)

Jump to: Solomon Amendment

Freedom of Information Act

Since 1967, the Freedom of Information Act (FOIA) has provided the public the right to request access to records from any federal agency. It is often described as the law that keeps citizens in the know about their government.

The Freedom of Information Act (FOIA) generally provides that any person has the right to request access to federal agency records or information except to the extent the records are protected from disclosure by any of nine exemptions contained in the law or by one of three special law enforcement record exclusions.

“The release of directory information without consent shall be limited to legitimate educational purposes or in accordance with the Solomon Amendment.”

Solomon Amendment

Colleges and universities are required to comply with the final regulations of the Solomon Amendment (effective 10/23/1998). Failure to comply may result in the loss of federal funding including various forms of federal student aid.

Note: The Solomon Amendment supersedes FERPA. Solomon is based on the definition of student recruiting information.
