Student Rights

Complainant Rights

To be treated with respect by all UM officials.
To have the Investigation Process conducted by officials who do not have a conflict of interest or bias for or against the parties and who receive annual training on the issues of sexual misconduct.
To participate in a Title IX Investigation Process that is conducted in a prompt, fair, reliable, and equitable manner, consistent with university policies.
Access to all university resources available to all students.
Access to access to an advisor of your choice.
To be informed of the availability of interim safety measures such as issuing a no-contact directive or changing academic, employment, or living situations to separate the parties involved.
To receive timely notice of all related meetings to attend.
Opportunity to inspect and review evidence obtained as part of the investigation.
Opportunity to review copy of the investigation report prior to it being finalized and sent to hearing board.
Receive updates on status, progress, and timeline of early informal resolution or investigation.
Receive periodic updates at reasonable intervals regarding the status of the Investigation and cause(s) for delay.
Knowledge of outcome or final decision of investigation in writing.
To have the process and timeline for requesting an appeal of the outcome and/or disciplinary sanctions explained.
Participate in an appeal of the investigation’s findings and/or of the discipline imposed.
To have an appeal conducted in a manner consistent with the processes outlined in university’s policy.
To be free from retaliation or intimidation for participating in the investigation process.

 

Respondent Rights

Access to notice of investigation that includes a reasonable description of the allegations.
Clear notice of the alleged policy(ies) violated.
Receive timely notice of all related meetings to attend.
Opportunity to inspect and review evidence obtained as part of the investigation.
Opportunity to know, fully and fairly defend all of the allegations, and respond to all evidence.
Opportunity to review copy of the investigation report prior to it being finalized and sent to hearing board.
Opportunity to know the identity of the reporting party and witnesses participating in the investigation.
Receive updates on status, progress, and timeline of early informal resolution or investigation.
Receive periodic updates at reasonable intervals regarding the status of the Investigation and cause(s) for delay.
Receive outcome or final decision of investigation in writing.
To have the process and timeline for requesting an appeal of the outcome and/or disciplinary sanctions explained.
To participate in an appeal of the Investigation’s findings and/or of the discipline imposed.
